Technical Advisor (Patent Litigation & PTAB)

Position Overview

A well-established law firm with a strong IP litigation and PTAB practice is seeking an experienced technical advisor to support its team in Washington, DC. Technical advisors are registered patent agents who collaborate with attorneys throughout all stages of patent matters, from the beginning of a case through trial, leveraging their advanced knowledge in scientific and technical fields to provide valuable legal services to clients. The ideal candidate for this role is a proactive self-starter with excellent problem-solving and multitasking abilities, a deep command of science, and the ability to communicate effectively with both legal and non-legal audiences. This position requires someone who thrives in a dynamic, deadline-driven environment and can build strong working relationships with senior partners and clients.

Responsibilities

Responsibilities may vary depending on the assigned project but generally include assisting attorneys in representing clients in contested patent proceedings. Specific duties include:

  • Utilize scientific and technical expertise to facilitate communication between inventors, experts, attorneys, and clients.

  • Advise attorneys on developing technical arguments and presenting scientific and technical data to non-scientific audiences.

  • Participate in all aspects of case investigation for assigned matters.

  • Assist attorneys with witness preparation and attend depositions, hearings, and arguments to provide guidance on technical matters.

  • Collaborate with attorneys to prepare petitions, responses, and other materials for proceedings before the Patent Trial and Appeal Board (PTAB) and district court litigations, including patentability analyses, prior art assessments, and infringement and validity contentions.

  • Work with expert witnesses and help develop declarations for use in infringement and validity disputes.

  • Provide guidance on presenting technical arguments and preparing demonstrative exhibits.

  • Assist attorneys in reviewing and interpreting scientific or specialized documents.

  • Gain a comprehensive understanding of clients' technological businesses and continue learning intellectual property law.

Qualifications

  • A Ph.D. in an engineering discipline (Electrical Engineering, Mechanical Engineering, Civil Engineering, biological engineering, etc.), computer science, physics, biology, or chemistry. Interdisciplinary experience in both high-tech and biotech/life sciences is preferred.

  • Admission to the Patent Bar.

  • A minimum of two years of prosecution or PTAB experience.

  • Demonstrated ability to analyze specialized data and documents from the perspective of your field of study.

  • A self-starter with a strong interest in intellectual property and a curiosity to learn.

  • A proactive attitude with a willingness to own projects and see them through to completion.

Location

On-site at the firm's Washington, DC office, with the option for remote work up to two days per week.
